Copyright Policy

1. Introduction

Classeasily Inc. ('Classeasily', 'we', 'us') respects the intellectual property rights of others and expects its users to do the same. This Copyright Policy describes how we address claims of copyright infringement regarding content posted on the Classeasily Platform by our users.

We comply with the notice and takedown provisions of the U.S. Digital Millennium Copyright Act ('DMCA') and similar provisions under applicable Canadian copyright law (the 'Copyright Act'). This policy outlines the procedures for submitting infringement notices and counter-notices.

2. Reporting Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any User Content or other material on the Classeasily Platform infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Classeasily to locate the material (e.g., the specific URL(s) on the Platform where the material is found).
  • Information reasonably sufficient to permit Classeasily to contact you, such as an address, telephone number, and, if available, an electronic mail address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Failure to include all of the above information may result in a delay in processing your notice or the notice being deemed invalid.

3. Designated Copyright Agent

Classeasily's Designated Copyright Agent to receive notifications of claimed infringement can be reached as follows:

Note: Only DMCA notices and copyright infringement claims should be sent to the Copyright Agent. Any other feedback, comments, requests for technical support, and other communications should be directed to Classeasily customer service through support@classeasily.com.

4. Procedure Upon Receiving a Valid Notice

Upon receipt of a valid DMCA infringement notification meeting the requirements outlined above, Classeasily will:

  • Expeditiously remove or disable access to the material that is claimed to be infringing.
  • Notify the user who posted the material ('Affected User') that we have removed or disabled access to the material.
  • Take reasonable steps to promptly notify the Affected User, providing them with a copy of the infringement notice.

5. Counter-Notice Procedure

If you are an Affected User and you believe that the material that was removed or disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notice containing the following information to our Designated Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled (e.g., the specific URL).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located (or the Federal Court in Toronto, Ontario, if your address is outside of Canada), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

If a valid counter-notice is received by the Copyright Agent, Classeasily may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Affected User, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Classeasily's sole discretion.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Classeasily has adopted a policy of terminating, in appropriate circumstances and at Classeasily's sole discretion, Users who are deemed to be repeat infringers. Classeasily may also at its sole discretion limit access to the Platform and/or terminate the accounts of any Users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Disclaimer

Please be aware that if you knowingly materially misrepresent that material or activity on the Platform is infringing your copyright, or that material or activity was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA or similar provisions under Canadian law.
